General Terms and Conditions (GTC) of theBlueHeart

1. Scope
These GTC apply to all orders of products via the theBlueHeart online shop.
Note: Donations made to theBlueHeart gGmbH are not covered by these GTC, but are subject to the separate donation terms of the gGmbH.
Deviating conditions of the customer are not recognized unless theBlueHeart explicitly agrees in writing.
2. Contract Partner, Conclusion of Contract
The purchase contract is concluded with:
theBlueHeart, Otto-Stadler-Str. 23c, 33100 Paderborn, Germany.
The contract is concluded as soon as the customer submits the order in the online shop and theBlueHeart accepts it via order confirmation by email.
2.1 Review and Correction of Entries:
Before the binding submission of the order via the online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. A useful technical aid for better error detection can be the browser’s zoom function, which enlarges the display. The customer can correct their entries using the usual keyboard and mouse functions until clicking the button that completes the order process.
2.2 Contract Language:
The contract is available in German and English.
2.3 Order Processing and Email Contact:
Order processing and contact usually take place by email and automated order processing. The customer must ensure that the email address provided for order processing is correct so that emails sent by the seller can be received at that address. In particular, when using spam filters, the customer must ensure that all emails sent by the seller or third parties commissioned by the seller for order processing can be delivered.
3. Products, Prices, and Shipping
- The offered products are clothing and accessories, including print-on-demand products, individually printed by the third-party provider Shirtigo upon receipt of the order.
- All prices are final prices including statutory VAT. Shipping costs are indicated separately.
- Deliveries are made exclusively within Germany.

Delivery Times:
- Stock products: usually 2–5 working days.
- Print-on-demand products: 7–12 working days, as each product is individually produced after the order is received.
4. Payment
Accepted payment methods:
- PayPal
- Visa
- Mastercard
- Maestro
- Apple Pay
- Google Pay
PayPal Payments:
If a PayPal payment method is selected, payment is processed through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter “PayPal”) in accordance with the PayPal Terms of Use:

By clicking the button to complete the order, theBlueHeart accepts the customer’s offer to pay at the time of the order.
Payment is made either at the time of order or according to the terms of the selected payment service provider.
5. Delivery
- Delivery takes place after payment has been received.
- If a product is unavailable, the customer will be informed immediately. Already paid amounts will be refunded.
6. Right of Withdrawal
Consumers have a right of withdrawal according to §§ 355 ff. BGB:
Withdrawal Period: 14 days from receipt of the goods.
Right of Withdrawal:
The withdrawal must be declared in writing (by email or letter). The goods must be returned in unused condition and in the original packaging.
Return Costs:
The cost of the return shipment is borne by theBlueHeart.
Consequences of Withdrawal:
After returning the goods, theBlueHeart will refund the purchase price within 14 days.
Note: Print-on-demand products with predefined designs fall under the normal right of withdrawal, as they are not customized according to customer specifications.
7. Returns
- Returns should be sent to: theBlueHeart, Otto-Stadler-Str. 23c, 33100 Paderborn, Germany.
- Please pack the goods carefully to avoid damage.
- Refunds will be made using the same payment method used for the order.
8. Warranty
Statutory warranty rights apply. Complaints or defects must be reported in writing to theBlueHeart immediately. Defective print-on-demand products are repaired or replaced by the provider Shirtigo.
9. Liability
theBlueHeart is only liable for damages resulting from intentional or grossly negligent breaches of duty. For simple negligence, theBlueHeart is only liable for the breach of essential contractual obligations (cardinal obligations).
10. Data Protection
Personal data is processed in accordance with the theBlueHeart privacy policy.
11. Alternative Dispute Resolution
theBlueHeart is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Final Provisions
- German law applies, excluding the UN Sales Convention (CISG).
- Place of jurisdiction is Paderborn, to the extent legally permissible.
